These Terms and Conditions outline the rules and regulations for the use of Pramod's Art Studio website, located at https://pramodarts.in.

By accessing this website, you agree to accept all the terms and conditions stated on this page. If you do not agree, please do not continue to use Pramod's Art Studio.

ELIGIBILITY TO USE THE WEBSITE

By using this website and placing an order, you confirm that you are at least 18 years old, or that you are using the site with the involvement and permission of a parent or legal guardian. If you do not meet these conditions, please do not use this site or make a purchase.

ABOUT ME

Hi, I’m Pramod Sharma, the artist behind Pramod's Art Studio. Every painting listed here is an original, handmade artwork created by me. I don’t sell prints or reproductions — just one-of-a-kind pieces made with passion.

WHAT I SELL

All artworks on this site are unique, original, unframed and painted by me. Once sold, an artwork is no longer available and will not be restocked or reproduced.

I’ve made every effort to display the colours and images of my paintings as accurately as possible on the website. However, I cannot guarantee that your device’s screen shows the exact colours, as display settings may vary.

COPYRIGHTS AND USAGE

When you buy a painting, you own the physical artwork — but not the rights to reproduce, publish, or use it commercially unless we’ve agreed to that in writing.

All copyright and intellectual property rights remain with me, Pramod Sharma.

PAYMENTS

You can pay securely through UPI transfer, Google Pay (GPay), BHIM, or Paytm, as per the instructions provided at the time of check-out. Once the transfer is made, we request that you share a screenshot of the transaction with us via email or WhatsApp for order confirmation. Please note, Razorpay or other third-party payment gateways are not used at this time.

Orders are confirmed only after successful payment. You will receive an email confirmation once your payment is received. The responsibility of furnishing correct email address and contact details lies with the customer (you).

SHIPPING AND DELIVERY

I currently ship only within India, and I handle all packing and shipping personally.

Processing time for orders is typically 2–4 business days.
Estimated delivery time: Within 7 business days after your order is confirmed.
Once shipped, you’ll receive a tracking ID via email or SMS.
Delivery timelines may vary based on festivals, national holidays, or regional delays.
We ship original artwork and other art-related products listed on our website. Each item is carefully packaged to ensure it reaches you in perfect condition.
Please note: We do not ship hazardous materials, illegal items, or any contraband content under any circumstances.

If your delivery address is in a remote location, shipping may take longer. In such cases, I may contact you to confirm delivery details. I use only reliable courier services or India Post Speed Post.

While I make every effort to pack and dispatch items carefully, Pramod's Art Studio (pramodarts.in) cannot be held responsible for any loss or damage that occurs during transit.

RETURNS, CANCELLATION AND REFUNDS

Due to the nature of original, handmade artwork, all sales are final. I do not accept returns, exchanges, or cancellations once an order is confirmed. I take great care in packaging your artwork. However, if your order arrives damaged, please contact me within 48 hours of receiving the item with clear photos of:

The damaged area(s)
The outer packaging (including any visible damage)
The artwork as it was unpacked

For faster and fairer resolution, I strongly recommend recording an unboxing video from the moment you begin opening the package until the artwork is fully visible. This helps verify any damage that may have occurred during shipping.

All damage claims will be reviewed carefully. Refunds or replacements (if offered) are at my sole discretion, based on the evidence provided.

Please note: Claims that appear to show damage caused after delivery or due to mishandling by the customer — without an unboxing video — may not be eligible for a refund or replacement.

PRIVACY AND DATA

Your personal information (such as your name, address, and contact details) is used only to process orders and communicate with you. I do not sell or share your information with third parties, except for necessary service(s) like shipping .

PROHIBITED USES

By using this site, you agree not to misuse or abuse it in any way.

You are not allowed to:

Use the site or its content for anything illegal, fraudulent, or harmful.
Attempt to hack, damage, or disrupt the website or services.
Violate anyone’s rights, including mine or others’ copyrights or privacy.
Upload viruses, spam, or anything that could interfere with site functionality.
Use the site to harass, harm, or discriminate against others.
Impersonate another person or submit false or misleading information.
Attempt to scrape, extract, or replicate any artwork or content on the site.

LIMITATION OF LIABILITY

I do my best to keep this website functional, accurate, and secure. However, I cannot be held responsible for:

Delays or disruptions in service.
Errors on the site.
Issues related to third-party services (like payment gateways or courier services).
Any losses or damages resulting from the use of this website or the purchase of artwork.

Use of the site and its content is at your own discretion and risk. My responsibility is limited to the fullest extent permitted by law.

INDEMNIFICATION

By using this site, you agree to take full responsibility for your actions. If you violate these Terms, break any laws, or harm others’ rights, you agree not to hold me (Pramod's Art Studio) responsible. You will also cover any related costs, including legal fees if necessary.

GOVERNING LAW

These Terms and Conditions are governed by the laws of India. Any disputes or claims related to the use of this website or any transactions shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana- India.

CHANGES TO TERMS AND CONDITIONS

I reserve the right to update, change, or replace any part of these Terms and Conditions at any time, without prior notice. It is your responsibility to review this page periodically. Your continued use of the website after changes are posted means you accept those changes.
